都計法與建築法專題研究

一． 課程內容

本課程每年僅開設一學期課程，所以本學期之討論主題將不再區隔成上學期─都市計畫法；下學期─建築法，而將混合成「公部門建設法」大標題下，予以綜合性討論。本學期擬討論之議題主要以「國土計劃法」草案為中心，其子題尚有：

1. 國土空間管制綜合法令體系及其矛盾
2. 特別之國土規制法：文資法、水保法、國家公園法等
3. 都市土地管制常見之判決紛爭分類
4. 非都市土地管制常見判決紛爭分類(尤其是農地)
5. 國土計劃法草案總檢討
6. 外國國土計劃法之主要內容
7. 國土計劃法與行政計畫法
8. 國土規劃與建築管理之關連


二． 評分標準

選課同學必須選擇一個子題作為課堂報告內容，其上課出席率、發言程度及
期末書面報告將成為評分之主要依據，在得授課教師允許下，亦得選擇其他相關議題，自訂題目報告。

The Seminar on Urban Planning Act and Construction Act

In this year, we’ll combine the issue of the Urban Planning Act and the Construction Act as “The Building Law in public department”, and to discuss this issues. In this semester, Our discussions will base on the draft plan of the “Territory Planning Act”, and other subtitle such as,
1. The legal system of the territory management and its antinomy.
2. The special legal system of the territory management: Cultural Heritage Preservation Act, Soil and Water Conservation Law, and National Park Law.
3. The judgment of the urban space management.
4. The judgment of the non-urban space management.
5. The review of the draft plan of the “Territory Planning Act”.
6. The main content of foreign “Territory Planning Act”.
7. “Territory Planning Act” and the Administration Planning Act.
8. Territory management and building management.
The participators should choose one issue as the theme of the report. The scores will be decided by the grade of the report, participation, and the attitude of class discussions.
